MAY 50-50 RAFFLE
OFFICIAL RULES AND CONDITIONS
Broward Performing Arts Foundation (“the Foundation”) is a not for profit 501(c)(3) charitable organization and conducting this 50-50 raffle (“Raffle”), or game of chance pursuant to Florida Statutes, Section 849.0935. This Raffle is a fundraising activity to benefit the charitable mission of the Foundation.
These Official Rules and Conditions govern the conduct of the Raffle and are binding on everyone who purchases or requests a Raffle entry or is named on a Raffle entry.
The winner will receive 50% of the proceeds from the Raffle, less required tax withholding (the “Prize”).
Participants must be 18 or older and a Florida resident. Only one eligible person may be entered in the Raffle per entry. If the name of more than one person is submitted with a Raffle entry, and that entry is selected as the winner, then the person named first will be deemed the winner. The Raffle winner will be required to execute an affidavit of eligibility and provide proof of identity to collect the prize. Members of the staff and administration of the Broward Center for the Performing Arts, the Foundation and the Performing Arts Center Authority and their immediate families are not eligible to participate.
HOW TO ENTER
Raffle entries may be purchased for a suggested minimum donation of one (1) entry for $10, three (3) entries for $25, or ten (10) entries for $50. Participants purchase entries by clicking HERE or by visiting the Broward Center website www.browardcenter.org/raffle between May 3, 2021 and May 28, 2021 at 11:30am. Each entry equals one entry in the drawing and there is no limit to the number of entries a participant may purchase. No refunds are available. Purchases of Raffle entries are not tax-deductible contributions.
No purchase or contribution is necessary to participate in the Raffle. There is a limit of one free or reduced contribution raffle entry per person. To receive a free entry or purchase a raffle entry for less than the suggested minimum contribution, please send your name, address, phone number and email address and indicate your request for a free or reduced contribution Raffle entry to 50-50 Raffle, Broward Performing Arts Foundation, 201 SW Fifth Avenue, Fort Lauderdale, FL 33312. All requests must be received by 11:59pm on May 26, 2021.
CONFIRMATION OF RECEIPT
Upon purchase or request, participant will receive an email confirmation.
THE RAFFLE DRAWING
The drawing will be held on May 28, 2021 at approximately noon at Broward Performing Arts Foundation, 201 SW Fifth Avenue, Fort Lauderdale, FL 33312. The winning entry will be chosen by random drawing from all entries purchased. The drawing will be conducted by the Foundation.
The Raffle winner will be notified by email and phone within 24 hours of the drawing.
The winner must contact the Foundation office at 954-468-3284 or at [email protected] within ten (10) days to make arrangements to receive the Prize. If the winner does not claim the Prize within the time period specified, the Prize will be forfeited and will be kept by the Foundation to support the Road to Recovery.
The winner must execute an Affidavit of Eligibility and Release and provide appropriate identification and documentation as determined by the Foundation. The Affidavit and documentation may be submitted electronically. Failure to provide the Affidavit and required documentation within 60 days of the drawing will cause the prize to be forfeited. All taxes are the responsibility of the prize winner and the Foundation will withhold taxes as required by law. Once the required documentation is received, the Foundation will mail a check in the amount of the prize less any required withholding to the winner.
Raffle entries are not transferable or assignable.
All entries must contain a name, address, email address and phone number to be valid.
The Raffle is void where prohibited or restricted by law.
Any and all taxes, fees, and other costs including but not limited to federal and, if applicable, state and local income and withholding taxes that may arise and be due or asserted on the value of the Prize are the sole responsibility of the Raffle winner. Odds of winning depend on the number of eligible entries received for the Raffle.
ALL RAFFLE PARTICIPANTS RELEASE, DISCHARGE AND HOLD HARMLESS THE FOUNDATION, BROWARD CENTER FOR THE PERFORMING ARTS, PERFORMING ARTS CENTER AUTHORITY AND EACH OF THEIR RESPECTIVE PARTNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS ("RELEASED PARTIES"), FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO, OR ARISE OUT OF, PARTICIPATION IN THE RAFFLE OR THE ACCEPTANCE, USE, MISUSE, NON/USE, OR POSSESSION OF THE PRIZE, OR ANY PRIZE-RELATED ACTIVITY, AND THE WINNER AGREES TO INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, EXPENSES (INCLUDING ATTORNEYS’ FEES AND EXPENSES), RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH OR AS A RESULT OF THE WINNER’S ACCEPTANCE OR USE OF THE PRIZE.
DISCLAIMER OF ALL OTHER REPRESENTATIONS AND WARRANTIES
There are no other representations or warranties other than set forth in these Official Rules and Conditions. The Released Parties disclaim all other representations and warranties expressed or implied regarding the Raffle. A participant’s sole and exclusive remedy against the Released Parties shall be limited to the purchase price paid for Raffle entries. The Released Parties are not responsible for any errors which may occur in connection with the administration of the Raffle, the processing of entries, the Notification, any other announcements or telephone or in-person conversations relating to the Raffle or in any Raffle-related materials. Released Parties are not responsible for, and the Foundation reserves the right to correct, typographical, clerical or printing errors in any Raffle-related materials, including these Official Rules and Conditions. Released Parties are not responsible or liable for any events beyond the control of the Foundation which may cause the Raffle to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alteration of, entries, nor are the Released Parties responsible for any failure of any Raffle entry to be processed on account of technical problems or human error, or any combination thereof.
The Foundation may exclude, disqualify or terminate participation in the Raffle to any entrant who, in the Foundation’s sole discretion: (a) ignores these Official Rules and Conditions; (b) acts in a manner the Foundation determines to be not fair; (c) acts with an intent to annoy, threaten or harass any other entrant or the Foundation; (d) acts in any other disruptive manner; or (e) tampers with the Raffle entry process. Sponsor reserves the right to make changes in the rules of the Raffle, which changes will become effective upon publication of revised Official Rules and Conditions at www.BrowardCenter.org/raffle-rules.
The Foundation reserves the right, in its sole discretion, to terminate, modify, or suspend Raffle entry sales should the Foundation determine, in its sole discretion, that any virus, bug, non-authorized human intervention or other causes have corrupted or affected the administration, security, fairness or proper conduct of the Raffle. In such case, the Foundation will conduct a random drawing from among all eligible entries received prior to the aforesaid action taken by Sponsor.
ANY ACT OR ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE RAFFLE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE FOUNDATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY INDIVIDUAL(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
CHOICE OF LAW AND JURISDICTION:
Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules and Conditions, or the rights and obligations of entrants, the potential winners and the Foundation in connection with any Raffle, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction) that might otherwise cause the application of the laws of any jurisdiction other than the State of Florida. Any action seeking legal or equitable relief arising out of or relating to any Raffle or these Official Rules shall be brought only in the courts of the State of Florida located in Broward County.
HOW WE USE THE INFORMATION THE FOUNDATION COLLECTS WHEN A RAFFLE ENTRY IS PURCHASED
The Foundation may use the personal information collected when you purchase or request a Raffle entry to communicate with you regarding special offers; to update information from either the Foundation, Broward Center, Parker Playhouse or Aventura Center; to offer you new services; or for other marketing purposes. We may also register you as a user to allow you to purchase and ship tickets, subscriptions, memberships or merchandise; customize our website content; or enable you to participate in special promotions and navigate PACA websites without having to re-enter information.

THE BROWARD PERFORMING ARTS FOUNDATION, INC., REGISTRATION NUMBER SC-00882, MEETS ALL REQUIREMENTS SPECIFIED BY THE FLORIDA SOLICITATION OF CONTRIBUTIONS ACT. A COPY OF THE OFFICIAL REGISTRATION AND FINANCIAL INFORMATION MAY BE OBTAINED FROM THE DIVISION OF CONSUMER SERVICES BY CALLING TOLL-FREE WITHIN THE STATE 1-800-435-7352 OR CONTACTING WWW.FLORIDACONSUMERHELP.COM. REGISTRATION DOES NOT IMPLY ENDORSEMENT, APPROVAL, OR RECOMMENDATION BY THE STATE. 100% OF YOUR CONTRIBUTION IS RECEIVED BY THE FOUNDATION.
